Terms of Service

These Terms of Service govern access to Webassy, a rental property software service for rental listings, applications, document collection, tenant portal workflows, rent tracking, and related property management activity. By creating an account, submitting an application, uploading documents, or using Webassy, you agree to these terms.
1. Webassy's Role
Webassy provides software tools. Webassy is not a landlord, property manager, real estate broker, attorney, consumer reporting agency, credit bureau, debt collector, bank, payment processor, or leasing decision maker. Landlords and property managers control their rental listings, application criteria, tenant communications, rent records, and leasing decisions.
2. Landlord and Property Manager Responsibilities
Landlords and property managers are responsible for their own legal compliance, including fair housing, rental application, tenant screening, security deposit, rent payment, document retention, privacy, and consumer reporting obligations. Landlords must use applicant and tenant information only for lawful rental and property management purposes.
- Do not request or use information in a discriminatory or unlawful way.
- Do not upload false, misleading, unauthorized, or unlawful content.
- Do not use Webassy to make prohibited housing decisions.
- Confirm that notices, disclosures, criteria, rent charges, late fees, and payment instructions comply with applicable law.
3. Applicant and Tenant Responsibilities
Applicants and tenants are responsible for submitting accurate information, uploading documents they are authorized to provide, and keeping account access secure. Submitting an application does not guarantee approval, housing availability, pricing, or lease terms.
4. Rental Applications and Documents
Applications may include sensitive personal, identity, income, employment, household, rental history, and supporting document information. Webassy stores and makes this information available to the landlord or property manager associated with the application. If a landlord requests tenant screening, Webassy may send the applicant to a third-party screening provider. Webassy does not act as a consumer reporting agency, does not make leasing decisions, and does not require landlords to use screening reports.
5. Subscriptions, Trials, and Billing
Landlords may build a draft setup before starting a paid trial. Publishing applicant links or activating paid features may require a Stripe Checkout subscription. Plan pricing, trial length, included features, and billing terms may change, but changes will not alter a paid period that has already started unless required by law or payment processor rules.
6. Rent Payments and Stripe Connect
Webassy can help landlords track rent received outside Webassy, such as check, Zelle, bank transfer, money order, cash, Venmo, Cash App, or other methods. If a landlord enables online rent payment, Stripe processes payments and Stripe Connect routes funds to the landlord's connected account. Webassy does not store landlord Stripe secret keys and does not guarantee payment approval, payout timing, dispute outcomes, or bank availability.
7. Tenant Screening Providers
Tenant screening may be provided by independent third-party services such as RentSpree, TransUnion SmartMove, or another provider selected by Webassy or the landlord. Applicants may be asked by that provider to authorize screening, submit information directly to the provider, and pay the provider's screening fee. The provider's own terms, privacy policy, fees, notices, and dispute process apply. Landlords are responsible for permissible purpose, applicant consent, fair housing compliance, adverse-action notices, and any other obligations that apply to their use of consumer reports.
8. Account Security and Acceptable Use
You must keep passwords and access codes secure. You may not attempt to bypass authentication, access another tenant's data, scrape the service, upload malware, overload the system, or use Webassy for unlawful activity.
9. Availability, Data, and Backups
Webassy aims to provide reliable service, but availability is not guaranteed. Webassy may perform maintenance, address security issues, or suspend access when needed to protect the service or comply with law. Users should keep their own copies of records they are legally required to maintain.
10. Service Changes and Termination
Webassy may add, change, or remove features. Webassy may suspend or terminate accounts for nonpayment, security concerns, unlawful use, or violations of these terms. Users may stop using Webassy at any time, subject to any active billing commitments and data retention obligations.
11. Disclaimers and Limits
Webassy is provided as-is and as-available. To the fullest extent allowed by law, Webassy disclaims implied warranties and is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages. Webassy's total liability for a claim is limited to the amount paid to Webassy for the service during the three months before the claim.
